Terms of Service

Please read these Terms carefully before using folioV. By creating an account or accessing the service you agree to be bound by these Terms.

1. Parties & Acceptance

These Terms of Service (“Terms”) form a legally binding agreement between you (“User”, “you”) and Rijkly (“we”, “us”), the operator of folioV at foliov.com.

By registering for, accessing, or using folioV you confirm that: (a) you are at least 16 years old; (b) you have the legal capacity to enter into this agreement; and (c) if acting on behalf of a company, you are authorised to bind that entity. If you do not agree to these Terms you must immediately stop using folioV.

2. Description of Service

folioV is a job-search management platform that provides:

  • AI-powered job-description evaluation against your CV and preferences.
  • Automated job portal scanning and deduplication.
  • Application pipeline tracking and management.
  • Portfolio and profile generation tools.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable to you for such changes, provided we give at least 14 days’ notice for material changes.

3. Accounts & Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at crew@foliov.com if you suspect unauthorised access.

You may not share your account, create multiple accounts to circumvent restrictions, or use another person’s account without permission.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a security risk.

4. Acceptable Use

You agree not to:

  • Use folioV for any unlawful purpose or in violation of any applicable law.
  • Scrape, crawl, or systematically extract data from the Service beyond what is intended by normal use.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Introduce malware, viruses, or any other harmful code into the Service.
  • Attempt to gain unauthorised access to any part of the Service, other users’ accounts, or our infrastructure.
  • Use automated scripts or bots to interact with the Service in a way that disrupts normal operation.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Upload content that is defamatory, harassing, obscene, or that infringes any third-party intellectual property rights.
  • Resell or sublicense the Service without our express written consent.
  • Use the Service in a manner that violates the terms of service of any third-party job portal you scan.

Violation of this section may result in immediate account suspension without refund.

5. User Content

You retain all intellectual property rights in content you submit to folioV (your CV, profile data, notes, etc.). By submitting content you grant Rijkly a limited, non-exclusive, worldwide, royalty-free licence to store, process, and display that content solely to provide the Service to you.

We do not use your CV or personal content to train AI models. Your content is transmitted to Anthropic’s API for inference only, consistent with Anthropic’s zero data-retention API policy.

You are solely responsible for ensuring you have the right to upload any content and that it does not infringe third-party rights. You indemnify us against any claims arising from your content.

6. Intellectual Property

All software, designs, logos, trademarks, and other materials made available throughfolioV (excluding User Content) are the exclusive property of Rijkly or our licensors and are protected by applicable intellectual property laws.

Nothing in these Terms grants you any right to use our trademarks, service marks, logos, or trade names without our prior written consent.

7. AI-Generated Content Disclaimer

The AI evaluation scores, summaries, coaching scripts, and recommendations generated by folioV are produced by automated models and are provided for informational purposes only. They do not constitute professional career, legal, or financial advice.

We make no warranty that AI outputs are accurate, complete, or suitable for any particular purpose. You must independently verify all AI-generated content before acting on it. Rijkly expressly disclaims all liability for decisions you make based on AI-generated outputs.

8. Third-Party Services & Links

folioV integrates with and scans third-party job portals. We are not responsible for the content, availability, or terms of those portals. Your use of third-party services is governed by their own terms and privacy policies.

When our scanner accesses third-party job pages it does so on your behalf. You are responsible for ensuring such access complies with the applicable portal’s terms of service.

9. Fees & Credits

folioV may offer free and paid tiers. Pricing, credit limits, and feature availability will be described on our pricing page or within the dashboard. We reserve the right to change pricing with at least 30 days’ notice to existing subscribers.

Unused credits do not roll over unless explicitly stated. Credits and subscription fees are non-refundable except where required by law or at our sole discretion.

10. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FOLIOV IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT ANY JOB LISTINGS RETRIEVED ARE ACCURATE, CURRENT, OR COMPLETE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RIJKLY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) €50.

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions our liability is limited to the greatest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Rijkly and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any applicable law or third-party right; or (e) your use of the job scanner in a manner that violates a third-party portal’s terms.

13. Dispute Resolution & Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles. You and Rijkly agree to first attempt to resolve any dispute informally by contacting us at legal@foliov.com. If a dispute is not resolved within 30 days, it shall be submitted to the competent courts of Amsterdam, the Netherlands, unless mandatory consumer protection law in your jurisdiction requires otherwise.

If you are an EU consumer, you may also use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

14. Termination

Either party may terminate these Terms at any time. You may delete your account from the dashboard settings. We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law.

Upon termination, your right to use the Service ceases. We will delete your personal data in accordance with our Privacy Policy. Sections 5, 6, 7, 10, 11, 12, and 13 survive termination.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice at least 14 days before the new Terms take effect. Continued use of the Service after the effective date constitutes acceptance. If you do not agree to the revised Terms, you must stop using the Service and delete your account.

16. Severability & Entire Agreement

If any provision of these Terms is held unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will continue in full force. These Terms (together with the Privacy Policy and Cookie Policy) constitute the entire agreement between you and Rijkly regarding the Service and supersede all prior agreements.
